Fort Portal High Court has dismissed three election petitions with charges

The High Court in Fort Portal has dismissed three election petitions with costs, filed against Hon Acrobert Kiiza Moses (Ind) for Bughendera county in Bundibugyo district, Hon Tom Butime for Mwenge Central in Kyenjojo district, and Tibakunirwa Robert the Bundibugyo district chairman.

The court presided over by Justice Rwakakooko Jeanne who denied journalist access to court chambers dismissed the petition of Mr Kibanzanga Christopher the former state defense and veteran affairs which he had filed against Hon Acrobert Kiiza Moses on reasons that the petitioner lacked sufficient evidence for the nullification of Acrobert Kiiza Moses’s victory.

Justice Rwakakooko Jeanne ruled that the petitioner should pay the costs of the respondent.

Makasi Alfred, Kibanzanga’s lawyer said that the Judge has said that the petitioner has not proved the allegations and we shall take necessary decisions after studying and understanding the judgment together with their client to see what really happened to their grounds.

Hon. Acrobert Kiiza Moses said that justice can be delayed but can’t be stopped, my victory for NRM primaries was grabbed and voters who had voted me told me to stand again and I won the general elections but the petitioner who was aggrieved went to court without case accusing me for bribing voters.

Acrobert called upon all people of Bughendera and Bundibugyo who had sectarianism information to come together and be calm and as a leader, I will not segregate against anybody.

In another election petition against Hon. Tom Butime the Mwenge Central constituency M.P and minister for tourism were also dismissed with costs.

The petitioner Mr. Muhumuza Simon in his election petition to court had sued both Hon. Tom Butime and UNEB on grounds that he lacked academic documents to be nominated for the parliamentary election for Mwenge Central constituency in Kyenjojo district.

According to Businge Victor the lawyer for Hon. Tom Butime said that the court found him having all required documents to stand as a Member of Parliament for Mwenge central and the petition was dismissed for the petitioner did not prove any of the grounds as set.

The petitioner Mr. Muhumuza Simon together with his lawyer have totally decertified with the judgment and they are going to appeal saying that some evidence was not considered.

The election petition of Bundibugyo district chairperson Mutegeki Ronald the former district chairman petitioned Mr. Tibakunirwa Robert was also dismissed.

Out of 13 election petitions filed at Fort Portal high court, eight cases have been handled where three of them were withdrawn by the petitioner.
